1. The agreement
These Terms & Conditions form a binding agreement between Trusty (the “Company”, “we”), a company registered in the Arab Republic of Egypt and the operator of Easy Collects, and the customer (“Customer”, “you”) that signs an Order Form or otherwise subscribes to the platform. By subscribing, you confirm that you have the authority to bind your organisation to these Terms.
2. The service
Easy Collects is a software-as-a-service platform that supports the day-to-day operations of money-collection companies. We provide the platform on a subscription basis and use reasonable commercial efforts to keep the service available, useful, and accurate.
3. Right to use
We grant you a non-exclusive, non-transferable right to access and use Easy Collects during your subscription term, for the named users and the entities specified in your Order Form. You may not resell, sublicence, or use the platform to provide a competing service.
4. Fees & invoicing
Subscription fees and the billing schedule are agreed in your Order Form. Invoices are payable within thirty (30) days of issuance unless agreed otherwise. We will provide reasonable notice of any change in pricing at renewal.
5. Your data is yours
You retain full ownership of all data you upload into Easy Collects. We make no claim of ownership over your data, and we do not use your data for any purpose other than running the service you have asked us to run. We act as a data processor; you act as the data controller.
6. Confidentiality
We treat the contents of your tenant — and any non-public information you share with us — as confidential. We will not disclose it except as strictly necessary to operate the service or where required by law. The duty is mutual and survives the end of the agreement.
7. Service availability
We commit to a target monthly availability of 99.9% for the production service, excluding scheduled maintenance announced in advance. Service credits for missed targets are documented in your Order Form.
8. Security commitment
We apply reasonable, industry-standard safeguards to protect your data. A summary of our security commitments is on our Security page; further detail can be provided to qualified procurement teams under NDA.
9. Compliance
Both parties agree to comply with all laws and regulations that apply to their activities, including data-protection laws and any sector-specific regulations governing collection activities.
10. Intellectual property
All rights to the Easy Collects platform — including the software, design, documentation, and trademarks — remain with the Company. Customer feedback shared with us is non-confidential and may be used to improve the platform.
11. Liability
To the fullest extent permitted by applicable law, our aggregate liability for any claim arising from the service is limited to the fees paid in the twelve (12) months preceding the claim. Neither party is liable for indirect, incidental, or consequential losses.
12. Term & termination
The agreement runs for the subscription term in your Order Form and renews automatically unless either party gives written notice. Either party may terminate for material breach not cured within thirty (30) days of written notice. On termination we will provide a reasonable window to export your data.
13. Events outside our control
Neither party is liable for delays or failures caused by events outside its reasonable control.
14. Governing law & disputes
These Terms are governed by the laws of the Arab Republic of Egypt. The parties will first try to resolve any dispute amicably; failing that, the competent courts of Cairo have exclusive jurisdiction, unless the Order Form provides for arbitration.
15. General
These Terms, together with the Order Form and our Privacy Policy and Data Processing Agreement, form the entire agreement between the parties.
